Comprehensive foreign media recently reported that on August 26, the British court ordered Samsung to pay compensation of 11.6 million US dollars to Swatch. The London High Court determined that Samsung listed digital replica dials for various luxury watches in its smartwatch app store, causing “serious damage” to Swatch. The court found that these apps imitated the dial designs of several Swatch brands, including Breguet, Blancpain, Omega, Longines, and Tissot. This compensation amount is far less than Swatch's $170 million claim. The judge said that the vast majority of the 11.6 million US dollar compensation stemmed from damage to rights caused by Samsung displaying Swatch's brand name on the App Store, and had nothing to do with whether consumers actually downloaded these apps. These watch face apps are not developed by Samsung, but by third-party developers. However, the court ruled that Samsung is also responsible, in part because Samsung controls the application review process and also uses beautiful dials to promote its own smartwatches.
