Since the current Road Traffic Safety Law came into effect in 2004, individual provisions were amended in 2007, 2011, and 2021. This time, it has ushered in its first systematic “overhaul”. From solving the old problem of random parking to solving the new situation of autonomous driving, from managing chaos such as “blind driving,” “drunk driving,” and “drag racing,” to eradicating chaos such as “open doors to kill” and “runaway groups”... This road traffic law revision takes into account the safety bottom line and the needs of the times, is problem-oriented, and focuses on convenience and benefit the people. In line with the rapid development of China's autonomous vehicle industry, a special section on “Special Provisions for Autonomous Vehicles” has been established in the revised draft road traffic safety law, which clearly stipulates that the state supports safe, orderly, and standardized road testing, demonstration applications, and driving of autonomous vehicles. All sectors of society are paying close attention to how to deal with the violation of autonomous vehicles. The draft stipulates that if a road traffic safety violation occurs while the autonomous driving function is activated, the autonomous vehicle manufacturer or importer shall be dealt with. If an autonomous vehicle manufacturer or importer believes that a road traffic safety violation has nothing to do with the autonomous driving function, it shall bear the burden of proof.
