A 900-Page Medical Record Hid a Six-Figure Detail. An AI Tool Caught It in Seconds.

Buried inside a 900-page medical file was a detail that could have gone unnoticed for an entire case: a client's prior back surgery and new injury were on opposite sides of the spine, a distinction an insurer could have used to argue the injury wasn't new.

Anthony A. Ciaccio, founding partner at Schalk, Ciaccio & Khan, caught it, flagged by Companion™, EvenUp's AI legal assistant. "Companion has helped me open up a whole new avenue of argument in my case that the insurance company is actually weighing," he said. He estimates the finding is worth hundreds of thousands.

The catch points to a broader imbalance in personal injury litigation: insurers can dedicate teams to poring over records for gaps to devalue a claim, while small firms often can't match that scrutiny. Schalk, Ciaccio & Khan had tried hiring nurses to build chronologies by hand, but each resigned over the tedious workload, pushing it back onto stretched staff. Treatment gaps went unnoticed until the defense found them.

Since adopting EvenUp's tools, the firm says it reviews records 10 times faster, responds to bills of particulars 90% faster, and cuts demand prep work 90%. Ciaccio, a former insurance defense attorney, said examiners often assume duplicate records are a deliberate ploy to inflate a claim, and catching those errors early has changed how insurers treat his filings.

The shift has changed how the firm spends its time. "With EvenUp, I'm able to work on more interesting and profitable work and no longer need to spend my Saturdays going through 10,000 pages of medical records," Ciaccio said.
