Q: We have noticed that the Ministry of Commerce's website published a preliminary ruling on the countervailing investigation against imported dairy products originating in the European Union. Can you explain the relevant situation? A: On August 21, 2024, in response to applications from the China Dairy Industry Association and the China Dairy Products Industry Association, the Ministry of Commerce initiated a countervailing investigation against imported dairy products originating in the European Union. Since the filing of the case, the Ministry of Commerce has always carried out investigations in strict accordance with Chinese laws and regulations and relevant WTO rules based on the principles of fairness, impartiality, openness and transparency to fully guarantee the rights of stakeholders. Currently, preliminary evidence indicates that there are subsidies for imported dairy products originating in the European Union, that relevant domestic industries in China have suffered substantial damage, and that there is a causal relationship between subsidies and material damage. According to the relevant provisions of the “Countervailing Regulations of the People's Republic of China”, the Ministry of Commerce issued a preliminary ruling notice on December 22, 2025, ruling that the ad valorem subsidy rate for EU companies is 21.9%-42.7%, and decided to implement temporary countervailing measures.
