On December 24, the Shanghai Higher People's Court issued “Certain Opinions of the Shanghai Higher People's Court on Providing Judicial Service Guarantees to Accelerate the Construction of the Shanghai International Financial Center”. According to the “Certain Opinions”, the Shanghai High Court will strengthen the protection of the rights and interests of small and medium-sized investors in the delisting process, support small and medium-sized investors to easily defend their rights through mechanisms such as representative litigation and model judgment; optimize procedures for third-party loss approval in securities civil compensation, improve the entrustment process and certification standards, balance public welfare and market-based requirements; improve the application of the priority principles of securities civil liability; and improve the judicial determination rules for information disclosure and transaction effectiveness under the differentiated positioning of multi-level capital markets.
